An arrest for an alleged drug or narcotics offence in Ghana can become serious very quickly. Whether the matter involves NACOC, the Police, an airport or courier investigation, possession, importation, exportation or another allegation, obtaining experienced legal representation at the earliest stage can make a significant difference.
Under Article 14 of Ghana’s 1992 Constitution, an arrested person has the right to be informed of the reason for the arrest and the right to a lawyer of their choice. Where the person is not released, the Constitution generally requires that they be brought before a court within 48 hours of arrest.
Bail Is a Legal Process — Not Just a Request
Where bail is available, the lawyer’s role may include:
– Attending the investigating authority and representing the client;
– Understanding precisely what offence is being alleged;
– Advising the client before and during questioning;
– Making representations for release or bail;
– Negotiating appropriate bail conditions where possible;
– Appearing before the court where court bail is required; and
– Protecting the client’s position as the investigation and criminal proceedings develop.
Every case is different. Bail should never be presented as guaranteed, particularly in serious narcotics matters. What a strong lawyer can do is act quickly, understand the evidence and allegations, and present the client’s legal position effectively.
